法院机制的中国化过程及其影响

司法体制和机制改革是新时代国家法治建设的重要组成部分,而法院的改革是其中重要内容之一。法院机制自清末引入以来,就一直处于"中国化"的变革之中,不同时期的改革在整个历史过程中呈现出极其复杂的状况,甚至出现短时期内的改革相互冲突和抵消。法院机制中国化的原因包括西方司法对中国传统的碰撞、新意识形态与经济方式的影响。法院机制进一步的改革中可以用外国法治经验来参照,但不能以此来否认中国法治自身特色、合理性及其应有的历史发展过程。

Indigenization of Court System in China and Its Influence

Reform of judicial system and mechanism,including the reform of court mechanism,is a major part of the rule of law construction in the new era. The current Chinese court mechanism is under a long-term reform,and the relationship between reform of different historical stage is very complicated,some even contradict with or offset each other. The reason of the reform includes the collision between western judicature and Chinese tradition,and the impact of new ideology and economic approach. Further reform of the court mechanism can use foreign experience for reference,but can’t deny the distinctive feature,rationality and history of China.
