庭审记录方式电子化改革的反思与建构

目前我国庭审记录方式电子化改革方案是在既有诉讼法律框架下的"谨慎尝试",是对立法与司法实践进行"弥合"的结果,尚未从本质上回应信息技术在庭审记录制度中的应用。改革旨在优化庭审记录方式,而非改变庭审记录的本质。从庭审记录的制度机理出发,我国庭审记录方式电子化改革应该强调司法权的引领作用,兼顾当事人的知情权、阅览权、使用权等诉讼权利。通过构建庭审同步录音录像与法庭笔录"并行式"范式,最大限度地彰显信息技术的进步价值。在合理确定基本架构和适用范围的基础上,改革应当不断强化保障,从有效性、便捷性、安全性等维度加强协调机制建设,进而促进庭审记录方式电子化改革规范有序进行。

Reflection and Construction of the Electronic Reform of the Court Record

The reform plan of our current electronic court record is more like the cautious trial under the existing litigation legal framework,which is the result of "bridging"the legislative and judicial practice,and has not fundamentally responded to the application of information technology in the court record system. The reform aims to optimize the way of the court record,not to change the nature of the court record. Starting from the mechanism of the court record,our electronic reform of the court record should emphasize the leading role of jurisdiction,give consideration to the litigant rights of litigant,such as the right to know,reading right,right to use and so on. By equaling the court synchronous audio and video recording with court record,highlighting the progressive value of information technology. On the basis of reasonably determining the basic framework and scope of application,the reform should continue to strengthen the guarantee construction. We should strengthen the construction of coordination mechanism from the dimensions of effectiveness,convenience and security,and then promote the standardization and orderly conduct of electronic reform of the court record.
