论法治评估功能的定位

当前人们对于法治评估的功能不够重视,还存在认识不同、定位不清,以及法治评估的功能异化、工具化、外在化、单一化、甚至被否定等现象。法治评估的功能定位不清或不当,不仅直接影响法治评估,而且将严重妨碍法治建设,因此,亟需对法治评估的功能进行明确、科学、合理的定位。法治评估的功能实质上就是治法--对法治的管理或治理,法治评估是一套法治治理机制--自查机制、公众参与机制、指引机制、认识机制、发现机制、纠错机制、倒逼机制等等。法治评估要具有可信度和有效性,才能充分发挥上述功能,达到治理法治,使法治落到实处,名副其实,实现良法善治的根本目的。

On Orientation of the Evaluation Function of Rule of Law

At present, people do not attach enough importance to the function of rule of law evaluation. There are still some phenomena, such as different understandings, unclear positioning, and alienation, instrumentalization, externalization, simplification and even denial of the function of rule of law evaluation, the unclear or inappropriate function positioning of the rule of law evaluation will not only directly affect the evaluation of the rule of law, but will also seriously impede the construction of the rule of law. There is an urgent need for a clear, scientific and rational orientation of the function of rule of law evaluation. The function of rule of law evaluation is essentially a set of mechanisms of rule of law governance, such as mechanism of self - examination ,public participation, guidance, recognition, discovery, and error - correcting , inversion, etc. Rule of law evaluation should be credible and effective, so as to give full play to the above functions, achieve the goal of rule of law governance, make rule of law come true, and achieve good governance of good law.
