| 摘 要： | 随着我国诉讼观念的更新,卧底侦查和诱惑侦查越来越受到大家的关注。作为侦查谋略,卧底侦查和诱惑侦查在刑事侦查学中历史悠久且应用广泛。实践中,卧底侦查和诱惑侦查的"交叉现象"频繁出现,这给学界探讨卧底侦查和诱惑侦查提出了新的问题。"交叉现象"使得学界需要从新的和更全面的角度去思考卧底侦查和诱惑侦查的概念、二者关系及相关的法律规制。

| Abstract: | With the renewal of our ideas about lawsuit,underground criminal investigation and temptation investigation are concerned increasingly.As investigation strategies,underground criminal investigation and temptation investigation have a long history in the criminal investigation theory and used widely.Practically,the" overlap" between underground criminal investigation and temptation investigation happens frequently,which put forward new questions to the academic circles.The" overlap" makes the academic circles ponder over the concepts of underground criminal investigation and temptation investigation,the relation between them and legal regulations on them. |
