关于检察机关适用刑事和解程序的若干问题探讨

刑事和解作为我国司法改革试验的一个热点,无疑是近些年来实务中探索较多、理论上争议较大的一种新型案件处理方式。2012年刑事诉讼法将刑事和解作为一种特别程序首次入法,并且以三个宏观框架性条款对其适用范围和适用条件做出了规定,这对于有效应对实践中的刑事和解混乱局面具有重要意义。我们在肯定该程序进步的同时,还必须看到其并没有从根本上解决刑事和解适用过程中存在的问题。通过对检察机关近几年适用刑事和解的情况进行实证调研,认为我国目前的刑事和解存在适用范围界定不合理、不同程序之间衔接困难、配套机制不完善等问题,而要解决上述问题,就必须重新界定刑事和解的适用范围、厘清程序之间转换的障碍、建立外部监督和制约机制等配套措施。

Discussion of the Questions About Application of Victim-offender-reconciliation System in Procuratorial Organ

Victim-offender-reconciliation as a hot-spot of judicial reform,has become a new solution which causes many exploration in practice and many disputes in theory in recent years without question.The Criminal Procedure law in 2012 puts ＂Victim-offender-reconciliation＂ as a special procedure into laws,besides rules applicable conditions and scope according to three macroscopic framework,thus it makes a contribution to dealing with the mess of Victim-offender-reconciliation in practice.When we affirm its progress,we must recognize that it does not solve the problems fundamentally in its application at the same time.By doing the actual research in the application of victim-offender-reconciliation in procuratorial organ in recent years,then points that it has problems such as applicable scope is not rational,different procedures are difficult to convergence,supporting mechanism is not perfect and so on,to solve the above questions,we must redefine its applicable scope,remove barriers of converging in different procedures,set up Surveillance and restriction mechanism and so on.
