对片面正犯与共犯理论的反思和批评

共同犯罪以主观意思联络为纽带,是区别于同时犯罪之关键。片面共同正犯违背共同犯罪的本质,从学理上突破了共同犯罪故意的界限和标准,同时违反共同犯罪人之间部分实行全部责任的归责原则;片面教唆犯是被教唆者没有意识到教唆者的教唆故意而产生了犯罪意思,即使引入片面教唆犯也难以确定行为人的刑事责任,且与我国关于教唆犯的基本概念相悖;片面帮助犯的提出是为了满足司法工作的实际要求,但片面帮助犯理论依然没有恰如其分地解决行为人的刑事责任问题,且我国从犯概念中还包括次要的实行犯。
