未成年人犯罪刑事立法完善之研究

顺应我国构建和谐社会的要求,针对司法实践中对未成年人适用刑罚社会效果不尽理想的现实,有必要对现行刑法及其他相关规范性文件中关于未成年人犯罪的刑事立法进行完善.具体而言:应当明确禁止对未成年犯罪人适用无期徒刑与罚金刑;严格限制未成年人的累犯构成条件;对未成年人建立"前科消灭制度";完善未成年人犯罪的非刑罚处置措施结构.

A Study on the Improvement of the Criminal Legislation on Juvenile Delinquency

Required by building the harmonious society in our country and with regard to the fact that the application of penalties for minors failed to have good social effects,it is necessary to improve the existing Criminal Law and other relevant documents on the criminal legislation of juvenile delinquency.For instance,life imprisonment and a fine should be prohibited for minors and the conditions for recidivism as minors should be strictly limited.The system of removal of the previous criminal record should be established for minors.Measures other than penalties against minors should be improved.
