| 摘 要： | 经营者安全保障义务是权利主体和义务主体之间的利益平衡器,应根据经营场所的损害事实、经营者的过错及因果关系,来确定违反安全保障义务侵权责任的承担,从而平衡社会利益和当事人之间的利益关系。
