论我国案外人异议制度的完善

案外人异议是案外第三人请求人民法院排除对特定标的物执行的一项重要法律制度,它对于切实维护当事人和案外人的合法权益起着十分重要的作用。但由于法律规定过于原则,该制度适用中出现了不少实际问题,远不能发挥其作为执行救济途径的保护和矫正作用。为了切实有效发挥该制度的应有作用,应针对具体适用中的缺陷和不足,进一步从程序上完善案外人异议制度。
