| 摘 要： | 我国现行刑事立案程序在运行中出现了虚置和异化的问题。其原因主要是立案条件设置过高，立案审查手段定性不明，在立案中受行政干扰严重等。所以我们要从完善立案的条件和标准，明确立案审查行为的性质，加强刑事立案程序运行的司法独立性等方面来加以改革和完善。
