通行权益的冲突与平衡--以道路交通事故责任为切入点

On Conflicting and Balancing of Interest of Passage--From the standpoint of liability for traffic accidents

There exists conflict between safety interest of pedestrians and non-motor vehicles and interest of fast and smooth traffic of motor vehicles in traffic safety. Legislators should balance interests of both parties through just distributing risk liability of traffic accidents, based on rule of law and human rights, so as to fully realize social interests and to attain the goal of keeping traffic order.
