监所检察视野下的罚金刑执行困境及出路

罚金刑在我国刑法中被广泛适用,但在司法实践中,大量的罚金刑得不到有效执行,严重地影响了司法权威。新修改的人民检察院《刑诉规则》将罚金刑执行的监督职责赋予给了监所检察部门,监所检察部门一定要适应形势,找准其中存在问题的原因,积极获取监督信息,找准监督内容,完善监督制约机制;同时,监所检察部门也要完善自身机构,把监督触角前伸,规范法院对罚金刑的判处,在减刑假释中加强对罪犯财产状况的调查,保证对罚金刑执行监督的不缺位。

Predicament and Outlet of Pecuniary Penalty Execution in View of Prisons and Reformatories Procuratorial Work

Though widely used in China＇s criminal law, pecuniary penalty has seriously affected the judicial authority in judicial practice by its ineffective implementation. The Amended Criminal Procedure Rules of People＇s Procuratorate grants the supervision of punishment implementation to the prisons and reformatories procuratorial departments. The prisons and reformatories procuratorial departments must adapt to the situation, find out causes of the problems, actively obtain supervision information, identify supervision content, and improve supervision mechanism. Meanwhile, these departments should also improve their mechanism, outstretch supervision tentacles, standardize court sentence on pecuniary penalty, and strengthen investigation of criminal property status in commutation and parole in order to ensure penalty execution under fully supervision.
