论行政权的正义性

行政权是一种能够增加社会公众福利的制度构建,能够体现此种目标的行政权被认为具有正义性。行政权的正义性是一种社会群体意志的评价结果,而不是遵从社会个体的正义感觉来评价。一般而言,行政权的正义性包含行政权的自由性、行政权的公平性和行政权的补偿性内容;只有同时具备此三项标准,行政权的正义性才是完整的。
