论我国仲裁证据保全权的分配

在仲裁实践中,证据往往会由于某种原因的存在而有灭失或今后难以取得的风险,因此在各国仲裁实践中,均须建立起合理的证据保全制度,而证据保全权如何分配是合理构建证据保全制度的关键.仲裁证据保全申请权应分配给当事人;仲裁证据保全执行权应分配给人民法院;在仲裁程序开始之前,仲裁证据保全的审查和决定权应分配给人民法院,在仲裁过程中,保全的审查和决定权应分配给仲裁机构,以此完善我国仲裁证据保全制度.
