著作权合理使用制度的人权法反思——基于必要性的考量

Reflection of Fair Use from Human Right Law Perspective: Based on the Consideration of Necessity

Fair use is the "safety valve" for rights’ protection and rights’ restriction in copyright law. To some extent, any change of its scope could give rise to human right problems, such as freedom of speech, right to education, right to privacy and so on. Looking back the events of intellectual property which related to human rights, rethinking the imbalance created by the same strong expansion in copyright protection and human rights protection, and then pointing out that the future change of fair use system should reflect its human right characteristic is of great significance undoubtedly.
