论契约自由原则在行政契约中的运用

随着现代行政法理念的转变，契约自由原则作为行政契约的一项重要原则得以引入到公法领域，其在具体的运用方面上显然会与私法领域的契约自由原则有较大差别。行政契约具有行政性和契约性的双重特性，行政契约的契约特性正是通过契约自由原则体现出来，所以，只有加强理论的研究与立法的完善，在保证行政目的得以实现的前提下，规范而不失灵活地在行政契约中运用契约自由的原则，才能更好促进行政契约的发展，加快政府职能的转变，最终实现民主行政、服务行政的理念。
