| 摘 要： | 司法解释是一种深刻地影响了并将继续影响着我国60年法治实践的力量。我国的司法解释沿着两条主线发展：一条是规范性的，体现为司法解释体制之演进；另一条是事实性的，体现为司法解释实践之展开。我国的司法解释应当沿着逐步去抽象化并逐步建立判例司法解释基本制度的方向发展。
