检察机关向乡镇延伸职能的双重路径选择

检察职能向乡镇延伸是检察机关服务大局、服务新农村建设新形势的必然要求,实践中出现了“聘任型”、“依托型”和“派驻型”3种延伸的主要模式。回顾检察机关向乡镇延伸职能的曲折历史,当前乡镇检察室的设置不宜一哄而上,而应因地制宜,采用“派驻型”与“依托型”并存的模式,在条件成熟的乡镇设置检察室,在条件尚未成熟的乡镇则依托综治中心延伸检察职能,以切实提高检察服务大局、服务社会主义新农村建设的成效。

To serve the country and the rural area requires the procuratorial organs to extend its function to villages and towns and the major models usually are the following three types： appointment, reliance and accreditation. Reflection on the history of procuratorial organ＇ s function extension in villages and towns, to set up the ＂township attorney room＂, we shall not rush headlong into mass action, but adjust measures to local conditions, and adopt a mode combining reliance and accreditation. In the villages and towns, if condition permits, the ＂township attorney room＂ shall be set up. Otherwise, the integrated management center shall be relied on to extend the prosecutorial function.
