| 摘 要： | 精神病人、儿童病人等无民事行为能力人或限制行为能力人,在医院住院治疗期间,有可能发生自杀、自伤、伤害他人等突发事件。在此类医疗纠纷的诉讼中,双方当事人往往会就监护责任问题发生争议。作者通过其亲自代理一个涉外医疗纠纷案例的体会,讨论了有关的法律问题。

| Abstract: | Psychopath and child patient, who are of no capacity for civil conduct or limited capacity for civil conduct, may suicide or hurt themselves or other people during their medical treatment period in the hospital. The dispute of liability of guardianship may be raised by both parties during the litigation of this kind of medical disputes. The author discussed relevant legal issues based on a medical dispute case related to foreigners represented by the author herself. |
