私有财产刑法保护的比较研究

中外对私有财产刑法保护在立法模式、保护对象及保护手段等方面均存在一定差异,我国现行刑法对私有财产保护尚有不足之处。在我国刑法中宜将无体物、财产性利益的保护作出明文规定,对私有财产和公有财产给予相同的保护,对财产犯罪宜限制适用死刑。

A Comparative Research on Criminal Law Protection of Private Property

China and foreign countries have differences in criminal law protection of private property in such aspects as legislative mode, protection target and means of protecting; the current criminal law of our country still has a weak point to the private property protection. In our country, incorporales and property protection of interests should be regulated among the criminal law, and offer the same protection with the property to the private property publicly-owned, death penalty to the crime of the property should be restrained in the application.
