包价旅游合同之违约精神损害赔偿研究

由包价旅游合同纠纷案可看出,因旅游经营者违约致旅游者精神享受利益受损现象愈来愈多,但目前对于精神损害赔偿请求权,学术界大多都主张以侵权之诉提起,并不认可违约精神损害赔偿。然而,侵权精神损害赔偿对旅游者来说有许多不利之处,相反,违约精神损害赔偿则容易很多。况且,包价旅游合同的特殊性在于以精神享受为目的,当旅游者只是精神享受利益受损、不存在违约与侵权责任竞合时,则无法提起侵权之诉,只能通过违约之诉来解决。我国应在借鉴域外法和国际性立法的基础上,将包价旅游合同之违约精神损害赔偿纳入到法律体系中。

Studies on Spiritual Damage Compensation for Breach of Package Tour Contract

The package tour contract disputes have revealed the phenomenon that, due to the travel operators＇ breach of contract, more and more tourists＇ interests of spirituous enjoyment are being harmed. Most academics advocate claiming compensation for tort liability and disapprove of spiritual damage compensation for breach of contract. However, claiming spiritual damage compensation may cause many disadvantages for tourists, while spiritual damage compensation for breach of contract will be much easier. Moreover, the particularity of package tour contract is to guarantee the tourists＇ interests of spirituous enjoyment. When the tourists＇ interests of spirituous enjoyment are harmed, but there＇ s no concurrence of liability for breach of contract and tort liability, the tourists cannot sue against the travel operators for tort liability, and the disputes can only he resolved by claiming spiritual damage compensation for breach of contract. On the basis of using foreign and international legislation for reference, it＇ s proposed that the spiritual damage compensation for breach of package tour contract should be stipulated in China＇ s legal system.
