| 摘 要： | 医疗侵权诉讼的许多问题突出反映在证明责任分配之中。通过将程序法与实体法相联系,将私法与社会保障法相衔接,对这个问题进行了较为系统的分析和讨论,勾绘出了一个客观评判医疗侵权,合理分担医疗风险的理论框架。

| Abstract: | There are many problems in tort action for medical malpractice which mostly exist in allocating burden of proof. This article analyse and discuss the problems systematically by means of connecting adjective law with material law, linking private law with social security law. The theoretical frame has been primary formed to judge medical malpractice objectibely and allocate medical risk reasonably. |
