论电子数据作为证据使用的法律障碍及其解决思路

在科技日益发达的今天,电子商务,作为一种新型的交易形式应运而生,而在发生纠纷时,电子数据能否作为证据,如果成为证据又应当如何确定其证据力、证明力,如何进行质证、认证,适用怎样的审查判断规则,都成为证据学当中研究的新问题。而现行的法律规定不能适应当前司法实践的要求,法律规范明显滞后,这是一个无法回避而又必须加以正视的现实问题。电子数据在现行法律体系下作为证据使用,还存在着一定的法律障碍。各国对解决这一问题都进行了非常有益的探索,我国也从实体和程序上进行了一定的努力,对此,文章从法理基础、证据归类、电子数据的真实性认定以及如何在司法实践中进行最终的审查判断进行了探讨。

The Legal Obstacles and Solutions to the Electronic Data as the Evidence

With the increasing development of the science,the Electronic Business has been born as a new form of transaction,but whether the electronic data can be regarded as eviderce,there are new problems arising.There are new questions in the subject of evidence:how we measure its strength of evidence and identification,how we use it to challenge the witness and notarize it and how we use laws that are related to it to protect our benefits.It is an evidence cannot be avoided that the laws nowadays cannot fit this case so we must face to the problem.There still are some legal obstacles when the electronic data is used as evidence nowadays.Some countries do some useful research on this problem including our country and so does the author.
