| Abstract: | It is a superficial understanding that criminal punishment is stipulated only by law. After an in depth analysis, the author verifies that social and political elements have profound influence on law making. Starting from the point of sociology, the power of punishment is directly derived from the political power of a state. Therefore, it is hardly surprising that the penal policy of a government has much to do with the system, structure and category of criminal punishment of the country. |
