| 摘 要： | 公证审查是公证机构进行的调查、核实活动。一般认为，公证审查主要有形式审查和实质审查两种基本方式，英关法系侧重于形式审查，大陆法系则侧重于实质审查。我国《公证法》对此未做出明确规定，实践中我国采用的是形式审查和实质审查相结合的方式。文章通过对各种审查方式的比较分析，并结合我国的国情，认为应以“有效审查”代替“形式审查与实质审查相结合”的审查方式定位，并对其价值作了简要阐述。
