| 摘 要： | 本文作者通过对不动产善意取得的理论基础、现实基础、制度基础和立法基础的分析提出了不动产的善意取得立法之可行性。并以此为基础排除了不动产抵押权善意取得的立法障碍;继而提出了抵押权善意取得存在的几点理由,为其立法提供了理论基石。

| Abstract: | The paper gives us a legislative feasibility on acquisition in good faith of real estate through a comprehensive analysis of theoretic basis, realistic basis, systemic basis and legislative basis about it. And then on the ground of it legislative obstacles that are concerned with acquisition in good faith of mortgage of real estate are removed. Finally several reasons why they exist as a cornerstone for legislation are put forward.. |
