| 摘 要： | 所有权不仅是物权法,而且是整个民法中最重要的概念之一。今年两会通过的物权法中明确提示了所有权的积极权能,符合传统的民法理念,但却未提示所有权的消极权能,明显存在概念不全面,内涵不明确的缺陷。消极全能是所有权绝对权、支配权的国有属性。

| Abstract: | The property is one of most important conceptions not only in the Law of Property but also in the civil law system.The Law of Property had been passed expounds the active foundation of the property and accordance with the traditional civil spirit.But the passive foundation of the property doesn't be point out.The conception of the property is not comprehensive and the connotation is not definite.The passive foundation is an intrinsic nature of the absolute right and the controlled right. |
