完善我国刑事证人保护制度的思考

完善刑事证人保护制度,对证人进行有效保护,既是消除证人作证顾虑、救济其合法权利的现实需要,也是保障被告人质证权、彰显刑事诉讼正当程序的必然要求,同时也是法律程序社会价值的体现.2012年修订后的《刑事诉讼法》对我国刑事证人保护制度进行了增补修改,在相当程度上弥补了原刑事证人保护制度的不足,但仍然存在一些缺憾.应进一步完善刑事证人保护立法,明确刑事证人保护的具体机构,健全刑事证人社会救助体系,确立刑事证人作证豁免制度.

We should further improve the criminal witness protection legislation, clear and specific protection of witnesses in criminal organizations, improve the social assistance system of criminal witnesses and establish criminal witnesses exemption system.
