| 摘 要： | 2017年新修订的《反不正当竞争法》是在改进原本《反不正当竞争法》在实践中所出现的问题之后的创新与发展,是《反不正当竞争法》的一次跨越和迈进。然而,《反不正当竞争法》的修订同时也为司法实践带来了全新的难题与挑战,如何看待一般条款与网络条款、如何处理一般条款与网络条款的适用关系等问题亟待找到一个合理的解决出口。

| Abstract: | The newly revised anti-unfair competition law in 2017 is an innovation and development after improving the problems in practice of the original anti-unfair competition law.It is a leap forward of the anti-unfair competition law.However,the revision of the anti-unfair competition law also brings new problems and difficulties to the judicial practice.How to treat the general provisions and Internet provisions,how to deal with the application of the general provisions and Internet provisions and other issues need to find a reasonable solution. |
