绿色原则在民法典物权编中的实现

环保的时代趋势推动绿色原则的提出,民法典分则编的修订相应地有了更高的要求。物权编绿色化的过程中不可避免地存在价值取向不一造成的矛盾冲突。通过解读绿色原则的内涵与意义能够更好地分析物权编绿色化的可行性。以所有权制度为例,立足于基本原则和目的条款,分析相邻关系、建筑物区分所有权、所有权取得这些现有制度如何注入绿色因子,探讨新增添附、先占和时效取得等制度的优势。据此提出物权编绿色化要树立体系意识与大局意识,着眼于制度的整体编排,结合实践中遇到的环保问题,协调物权需求与环境保护需求。在不影响民法职责与分工的基础上,增添物权编的环保属性,设立和完善相关民事制度,间接地实现民法对环境的保护作用,实现公益与私益的双赢。

Realization of the Green Principle in the Compilation of Civil Code

The trend of the era of environmental protection promotes the introduction of the green principle,and correspondingly has higher requirements for the revision of the civil code.In the process of greening property rights,there are inevitably conflicts caused by different values.By interpreting the connotation and meaning of the green principle,the feasibility of greening property rights can be better analyzed.Taking the ownership system as an example,the thesis,based on the basic principles and purpose clauses,analyzes how to inject green factors into the relationship between adjacent relations,building distinctive ownership and acquisition of ownership,and explores the advantages of new systems such as addition,preemption and timeliness.Based on this,it is proposed to establish a sense of system awareness and overall situation in the greening of property rights,to focus on the overall arrangement of the system by combining the environmental problems encountered in practice and coordinating the demand for property rights and environmental protection needs,and on the basis of not affecting civil legal duties and division of labor,to increase the environmental protection attributes of property rights,to establish and improve relevant civil systems,to clarify civil environmental rights and obligations,to indirectly realize the protection of civil law to the environment,and to realize public interests and individual interests in a win-win way.
