海峡两岸区际冲突法中公共秩序保留制度的和谐发展

关于区际冲突法上的公共秩序保留,理论上存在不同的观点,各复合法域国家的实践也不尽相同。两地间的国内公共秩序保留制度存在广泛的协调空间,海峡两岸区际冲突法中应当谨慎地适用公共秩序保留制度,从司法程序的角度严格限制公共秩序保留的适用,在需要援用公共秩序保留制度时,应首先寻求平等协商的方式加以解决,而不轻易地适用公共秩序保留制度,更不能使公共秩序保留制度成为保护地方利益的手段。

There are various opinions about reservation of public order of inter-regional conflict of laws in theory,and the practice of countries in the field of composite laws is also different.There are lots of places to be coordinated in the domestic system of reservation of public order between the two sides.The system of reservation of public order should be cautiously applied to conflicting laws between the straits.The application of reservation of public order should be strictly confined from the angle of judicial justice.When the system of reservation of public order is to be employed,ways of equal consultation should be first applied to solve the conflicts.The system of reservation of public order should not be easily applied,not even to make it be the means of protecting local interests.
