行政法对物权的保护问题研究

物权法的颁布,有力的推进了我们国家依法治国,建设社会主义法制国家的进程。从私法的角度而言,物权法的出台为私法保护物权提供了坚实有力的法律基础;从公法的角度而言,物权法的出台进一步划清了公权行使的范围,对政府开展依法行政和转变政府职能提出了更高的要求,在一定意义上行政法如何保护物权,是对行政法学的一个考验。我们立足于我国物权的行政法保护与规制的现状,分析了我国物权行政法保护与规制制度存在的问题。最后从完善的角度提出了建议,以期能够尽快健全与物权法相匹配的行政法制度。

Research on Protection of Property Rights by Administrative Law

The promulgation of the Property Rights Law,a strong advance of our country according to law building a socialist country ruled by law in the process.From the perspective of Private Property Rights Law,promulgated for the protection of private property rights provide a solid legal basis;From the perspective of law,property rights law to take further draw the exercise of public power,right government of law and the transformation of government functions in a higher demand,In a certain sense,the administrative law how to protect property rights that is the test for administrative law.The author based on the administrative law to protect our property rights and regulation of the status quo of our country,and analysis the problem of China's administrative law in protecting property rights and regulatory system.Finally,perfecting from the perspective of the proposals with a view to quickly improve the matching method with the real system of administrative law.
