保障性住房分配的刑法控制

保障性住房是我国的一项重大的民生工程,是实现社会分配公平的重要手段.但是,由于我国诚信体系不健全等原因,骗取保障性住房的行为屡屡发生,这不但侵害了保障性住房的所有权和相关财产性权益,还严重破坏了保障性住房的公平分配秩序,已经触犯了刑法,应当承担刑事责任.而目前地方政府出台的《保障性住房管理条例》中对这类行为的处罚仅仅只是罚款和在一定期限内不准申请保障房,很难对这类行为形成震慑力.因此,为了确保保障性住房的公平分配,有必要用刑法对骗取保障性住房的行为进行规制.

The Criminal Law Control in Indemnificatory Housing Allocation

Indemnificatory Housing is an important project to improve livelihood issue and a main measure to realize the society fairness allocation.However,because of the insufficiency or drawbacks of relevant laws,the frequently scandals of cheating indemnificatory housing are brought to the spotlight;these actions do not only infringe upon the legal housing possession rights and interests of relevant property but also disrupt the order of fairness allocation,which have violated the criminal law,and the violators should be responsible for the criminal liability.Ironically,in the regulations for indemnificatory housing,what is currently established by the local government,the punishments merely include imposing fines and restrictive application in a certain period,which is hard to effectively prevent these violations.Therefore,to make sure the fairness in indemnificatory housing allocation,there is necessary to regulate the behavior with criminal law.
