后现代主义之石：可攻民法方法论之玉

后现代主义形成于20世纪60年代,尽管它有光“破”不“立”的缺陷,但其注重多样性、差异性、特别性,强调多元性、联系和整体有机性,对于避免以往民法学研究中的片面化局限,提供了可资借鉴的更具包容性的多向度、多视角的研究方法。民法学研究当采多学科、大整合的方法,赋较具综合性的民法哲学和民法文化学以应有的位置。

On Using the Later Modernism for Reference in the Methodology of Civil Law

In spite of its defects,the later modernism which came into being in1960s provides the study of Civil Law with valu able methods.Because the later modernism lays stress on pluralistic,relative and organic characters as well as diversity and particu larity,thus can avoid one-sidedness in the study of civil law.This paper discusses that the study of Civil Law should have the aid of branches of learning and give philosophy and culturology of Civil Law their deserved positions.
