国有资产管理委托代理论思考

委托代理论在我国经营性国有资产管理体制改革过程中发挥了重要作用，依据该理论，参与管理国有资产的各方主体之间形成了“六层级五委托”的双向多级委托代理链条。然而，当我们细致分析国有资产管理主体之间的法律关系时却发现，不同主体之间或表现为代表关系，或表现为信托关系，或表现为特殊的委托代理关系。这要求我们务必理顺各方管理主体之间的法律关系，并在此基础上进一步完善我国国有资产管理体制，深化国有企业公司制股份制改革。

Consideration on the Principal-Agent Theory in the State-owned Assets Management

The Principal-Agent Theory played an important role during the reform of State-owned assets management. According to this theory, a two-way principal-agent chain which called ＂six levels and five principals＂ came into being during the management of State-owned assets. However, when we look into the legal relationship among these bodies in the process, we will know there are several kinds of relationships, including represent - relationship, trust-relationship and special principal-agent relationship. Thereafter, we should have to find out the legal relationship among these bodies, and perfect the management system of State-owned assets and deepen the company-share reformation of State-owned companies.
