试议民事强制执行救济制度的完善

民事强制执行制度是人民法院按照执行根据,运用国家强制力,依照法定程序,迫使被申请执行人实现生效法律文书所定权利的一种司法制度。结合德国、日本、我国台湾地区较为完备的执行救济制度,我国执行救济制度的完善:1.建立专门的执行机关,统一行使国家的执行权;2.建立债务人异议之诉;3.建立第三人异议之诉;4.建立执行救济的监督程序;5.建立执行救济的复议程序和上诉程序。

Opinion on Perfecting Relief System of Civil Execution

Civil Execution is a kind of judicial system carried by people's courts on the ground of certain rules of law enforcement,applying the powers of a country under the laws to force the party against whom an application is filed to exert the powers of efficient laws.Comparing with the comparatively perfect relief systems from Germany,Japan,Taiwan district of China,how can we make it better to do for the relief system: 1.Construct a special department to enforce,exercising the enforcement power of the country;2.Found a suit for debtor on doubtful points;3.Found a suit for the third person on doubtful points;4.Construct supervision system for relief enforcement;5.Constructing reexamination and appeal procedures for relief enforcement.
