论遗失物拾得

本文通过分析我国《民法通则》第79条第2款及相关司法解释的规定,对我国关于遗失物民事立法制度进行探究和评析,指出了其存在的种种弊端,并提出:我国在遗失物立法上应当确立一种双轨制度来确立遗失物的归属、规范遗失物的返还。本文还结合各国、地区立法例和我国历史上及实践中的实证详细叙述了双轨制度的内容。

On Picking up Lost Property

Through analyzing Article 79, section 2 of our Civil General Rule and the related judicial interpretation, this article will explore and appraise the civil legislative system of China concerning lost property. At the same time, it will point out the existing disadvantages and suggest that a kind of double-track-system on lost property legislation deciding the ownership of the lost property and standardizing the return system should be built. Also, the paper shows us in detail the content of this system connecting with other countries' and regions' legislative cases as well as the authentic proof in Chinese history and in practice.
