论大陆架划界之公平原则——兼及东海大陆架划界问题在公平原则下的考察

公平原则作为大陆架划界的基本原则的地位是在国际实践中逐步确立的,并且已经成为习惯国际法的一部分.其内涵在于,追求划界结果的公正与合理.自然延伸、等距离、成比例、协商等划界的原则与方法,只有在符合公平原则的基础上才能加以适用.在东海大陆架划界问题上,公平原则也应该起主导作用.

On the Equitable Principles in the Delimitation of the Continental Shelf ——with Reviewing the Delimitation of the Continental Shelf in the East Sea Based on Equitable Principle

As a basic principle in the delimitation,equitable principle has been established gradually in international practice,and become one part of international practices.It is to seek for an equitable and rational result.Principles of delimitation of the continental shelf,such as principle of natural prolongation,equidistance principle,proportionality principle,and negociation principle,can be applied only based on equitable principle.So equitable principle should play a leading role in solving the problem of Delimitation ofthe Continental Shelf in the East sea.
