| 摘 要： | 检察官的职务独立性能够保证检察官处理司法事务的纯正性。以检察官的法律定位和检察组织体系内部的权力配置方式为视角,考察现代主要法治国家和地区的检察官制度,保障检察官职务独立性的制度设计的重要意义就会显现。检察官职务独立性能够作为主诉检察官制度的理论基础,对其进行研习能够为主诉检察官制度的进一步发展起到理论指导作用。

| Abstract: | The functionary independence of the procurator in dealing with judicial affairs is of great significance for the judicial integrity.From the perspectives of constitutional structure and the internal power configuration of the prosecutorial organs,the meaning of the independence of the Prosecutor in modern areas ruled by law is described and explained.As the theoretical foundation of the principal prosecutors,main form of the prosecutor in China,the independence of the Prosecutor can play a theoretical guiding role in its development. |
