农民工养老保险地方立法及实践反思

由于我国社会保障法律制度体系中没有一部系统的社会保障法，有关农民工养老保险立法大多是授权地方立法来规定的，由此形成了统一立法、单独立法和综合立法三种模式。在实践上，各地立法不一，农民工养老保险待遇不尽相同，缺少养老保险衔接转移的相关权利义务规定．从而使农民工养老保险很难落到实处。

On the Local Legislation and Practice of Endowment Insurance for Farmer-Workers

since still no systematic law of social insurance is contained in our insurance law system,in most of the places,local legislative department makes the legislation of farmer-worker's endowment insurance.Different places may choose different models among unified legislation,independent legislation or comprehensive legislation.As a result,different places have different way of practice with no coordination among each other,which make it very difficult to settle the matters of farmer-workers' endowment insurance.
