公安行政执法是公安机关及其人民警察依照法定的职权和程序执行法律法规和规章，从而直接影响公民、法人和其他组织的权利和义务的具体行政行为.目前警察行政执法存在越权执法、以特权思想执法、随意性执法、不遵守法定程序等不足。究其原因主要有相关法律不完善、执法观念落后、财政保障格局不合理、评价机制缺乏科学性、警察素质不高和监督制约机制不健全等。应严格限制非警务活动、完善行政立法、强化民警法治意识、深化体制改革、建立科学的评价体系、加大执法培训力度、加强执法监督，提高公安行政执法水平。
