| 摘 要： | 以《鹿特丹规则》对中国进出口贸易,特别是对货方利益影响的调研为基础,对货方在调查中对规则的反应进行梳理,分析中国被动适用该规则的情况,着重对《鹿特丹规则》涉及货方利益的条款,如托运人义务、承运人的责任和免责、海运履约方、单证托运人、FOB卖方、无单放货、控制权、电子运输单证等条款对货方的影响进行评估。
