企业民主管理和谐博弈及法律风险

从民事权利义务上讲，企业民主管理是职工与企业之间因未确定的权利义务而进行平等协商的民事活动，是为了实现双方权益最大化、可持续平衡的和谐博弈。法律保护自由、平等协商的权利，但并不保障任何一方权益目标的实现，目标是否实现取决于双方在法律体系内的和谐博弈，排斥民主管理则把博弈推向和谐限度之外。
