卓越法律人才培养中法律文书学师资队伍建设的困境与对策

重理论教学而轻实践技能的训练导致法科毕业生职业能力难以满足用人单位选人用人之需和建设社会主义法治国家之需是以往我国法学教育的一大硬伤。因此,摆脱这种困境的关键措施之一是加强实践性教学,使法学教育职业化以训练学生的法律职业能力。这就急需师资队伍的实践化。法律文书学课程既可以综合训练学生的法律思维能力、法律解释能力、法律推理能力、法律论证能力和法律事实探知能力,也可以训练学生的法律文书制作技能,可现在该课程的师资队伍却存在着某些不尽如人意之处,难以满足法学教育职业化的需要,所以,应当采取有力措施加强其师资队伍建设。

The Dilemmas and Countermeasures of Construction of Teachers Team of Law Writing in Outstanding Legal Talents Training

In our law education, theoretic teaching is regarded but practical teaching is despised, so the occupational ability of the law graduates isn’t very good. Their skills to use laws can’t meet the needs of units that employ persons and building a socialist country ruled by law. Thus, one of the key measures to get rid of this puzzledom is the practical teaching should be strengthened and the legal education should be professionalized in order to cultivate the legal occupation ability of students. This urgently needs faculty practice. The law writing course may systematically train the legal thinking ability, legal interpretation ability, legal reasoning ability, legal argumentation ability and legal facts finding ability of students, also train the legal instrument making skills of students. But there are some not just as one wishes in the teachers group of this course. This situation is difficult to meet the needs of the education of law occupation, so some forceful measures to reinforce the construction of practical teachers group should be adopted.
