论行政诉讼中公民死亡后的原告资格转移问题

行政诉讼原告资格转移制度所保护的是原始原告的合法权利和与原始原告有直接利害关系的承继原告的合法权利。承继原告资格的取得,应基于其所享有的身份权、名誉权、继承权、受遗赠权、公法债权、私法债权及其他合法实体权利,由此承继原告不应受现行法律规定的近亲属范围的限定。承继原告的范围应包括原始原告的近亲属和近亲属之外的遗赠抚养人、公法债权人、私法债权人、受遗赠人、原始原告生前所在的单位或基层组织以及其他利害关系人。

On the Plaintiff''''s Qualification Transfer after a Citizen''''s Death in Administrative Litigation

In administrative litigation, the plaintiff's qualification transfer system aims to protect the legal rights of original plaintiff and legal rights of the succeeding plaintiff with direct interests of original plaintiff. The acquisition of qualification of the succeeding plaintiff should be based on the rights of paternity, right of reputation, right of inheritance, public law obligation right, private law obligation right and other legal substantive rights. So, the succeeding plaintiff should not be restricted to the scope of next-of-kin stipulated in the current laws. The scope of the succeeding plaintiff should include the next-of-kin of the original plaintiff and other persons with direct interests.
