社会转型中个人权利维护的现状与阻碍

权利与权力是政治学中两个最重要的概念,权利本位是现代社会的本质特征,处于转型期的中国社会存在着很多个人权利维护的阻碍因素,还远没有达到权利主导下的权利与权力的和谐。权力与权利的不和谐会导致社会成员普遍焦虑,影响行政管理的有效性和政治的合法性等。从政治角度分析,造成这种不和谐的主要原因有：政府法治程度不足,精英政治盛行,政府职能界定不清晰,国家与社会的分离程度不足和政治文化传统中对个人权利的不够尊重,等等。

The Status quo and Barriers of the Protection of Individual Rights in Social Transition

Right and power are the most important concepts in politics.Right-orientation is the essential feature of modern society.Since China is still in social transition period,there are too many barriers to the protection of individual rights.While the harmony between rights and power,which is guided by rights,has not been established.The unharmonious situation between rights and power has caused lots of results,including general anxiety over the society,inefficient administration,and political legitimacy fluctuation.Analyzing the situation with political view,we got the following reasons： low degree of government ruled with law,prevail elite politics,unclear government functions,low degree of separation between state and society,lack of respect from political and cultural traditions to individual rights,and so on.
