| 摘 要： | 法律的现代化就是使社会生活中的法现代性因素不断增多，以真正体现现代社会生活中法的特征。实现法律的现代化，以现代化的法律促成并维护社会的转型，已成为中国法治建设的不归选择。民法现代化过程中的价值因素、形式因素和事实因素是密切相关、相互依赖的有机整体。自然法学为我们提供了民法现代化的价值目标，分析实证法学为我们提供了民法现代化的表现形式，社会学法学为我们提供了明了法律现实以及实现现代化的有效手段。宽容、综合、整体性应是我国民法现代化应有的态度。
