论市场经济条件下公证制度的完善

中国的公证制度应当在提高经济活动的有序性、安全性、预防和减少社会纠纷和诉讼活动、节约经济成本与时间成本方面,发挥独特的功能和作用。本文拟从市场经济条件下公证制度与经济发展之间的互动关系角度,寻求进一步发挥公证的功能和作用的有效途径,从而完善我国的公证制度,实现法律公平和经济效率。

On the Improvement of Chinese Notarization System under the Terms of Market Economy

The market economy pursues the efficiency,and honest and credis is regarded as the foundation of making contracts. Decreasing dissension could be considering as increased efficiency.Chinese Notarization System should have a special function in the following:economizing the economic cost and time cost,increasing the order and the safe of economic activities,preventing and reducing the social dissension and litigant activities.This thesis intends finding out a valid way to further develop the function of notarization from the interact relations between notarization system and economic development under the terms of market economy,and realize law equity and economic efficiency.
