| 摘 要： | 我国《物权法》第195条对于抵押权强制执行作出了规定，但缺乏可操作性。在现阶段应充分发挥公证债权文书的作用，完善相应执行立法，并使法院在抵押权的强制拍卖中起主导作用。

| Abstract: | Although the Property Law article 195 stipulates the enforcement of the mortgage right, it is mere absence. In this stage, we should play the role of notary credit documents and improve the enforcement legislation. The court should play a leading role in compulsory auction. |
