| 摘 要： | 将受贿罪依照贪污罪处罚会导致一系列理论与实践上的困惑,不符合国际上通行的立法精神,不具有依照处罚的依据与基础,加司法部门的工作难度,不能满足受贿罪实际发展的需要,不利于打击与预防受贿犯罪。
